Elite Flooring & Interiors General Terms and Conditions:
This Contract is the entire agreement between the parties and no other terms shall be deemed to be incorporated into the Contract unless agreed in writing between Elite Flooring & Interiors (EFI) and the Customer/Client.
Elite Flooring & Interiors will guarantee against defects in workmanship for a period of one (1) year from the first day of installation. All materials carry the manufacturer's warranty and can be obtained from the manufacturer’s website. If EFI installs materials not supplied by EFI, a warranty is not given for the material or workmanship. EFI will not be responsible for damage caused by the customer.
Standards of quality are subject to industry standards and tolerances and not at the customer's discretion. Customer agrees that installation practices, methods and remedies are determined by Elite Flooring & Interiors and not by the customer.
Returns
There are no returns of special-order carpet, tile, vinyl, rugs, or other flooring. There are no returns of cut or installed flooring. If the manufacturer deems the material is eligible for return, customer will be responsible for any restocking fees.
Seams
We guarantee professionally constructed durable carpet and vinyl seams. Professionally constructed seams are not guaranteed to be invisible seams. There are many factors affecting whether a seam will be visible including but not limited to the type and amount of natural or artificial lighting in the room, the thickness, construction, and color of the carpet/vinyl.
Unforeseen Circumstances
Pricing is predicated upon normal conditions being encountered. If any unusual, hidden, concealed, or unforeseen conditions are encountered, such as but not limited to termite-infestation, decayed material, or hazardous materials, extra charges will be necessary to correct the issue. If asbestos, lead paint, or other hazardous materials are encountered, all liability is the client's sole responsibility to remove these hazardous materials before installation.
It is impossible to know if and how much leveling of a sub-floor may be required before the existing floor is removed. If leveling is required, an additional charge may apply. Other such circumstances arise from time to time.
Jobsite Conditions & Acclimation
The jobsite must be maintained at a controlled relative humidity of 35-55% and a temperature of 60-80 degrees Fahrenheit. This will allow for optimum dimensional stability. It is the client’s responsibility to maintain the proper site conditions. Neglecting the suggested humidity levels will result in voiding the product warranty of wood, laminate or LVP and workmanship warranty.
Some flooring requires acclimation prior to installation. The jobsite must be controlled 3-5 days prior to and during acclimation. This process depends on several environmental factors. EFI has no control over the time it takes for a product to become acclimated.
It is the homeowner’s responsibility to ensure that "crawlspaces" are properly encapsulated, free of mold and at an acceptable moisture level prior to purchasing new flooring. Crawlspaces should have 100% ground coverage of 6mil plastic. Issues caused by crawlspace moisture are not covered under warranty. EFI will not be held liable for floor covering issues caused by improper jobsite conditions.
Appliances/Plumbing Fixtures/Electronics/Contents
Our installers do not disconnect or reconnect gas stoves, gas dryers, sinks, dishwashers, etc. Occasionally, toilet flanges will not be at the correct height after new floors have been installed. If needed, it is the client's responsibility to hire a plumber or electrician to make any necessary adjustments or connections.
Our installers are careful when moving items, however all items are moved at the client’s own risk.
Our installers do not disconnect or reconnect any electrical equipment such as TV’s, computers, stereos, etc.
Demolition Liability/Paint, Drywall & Wood Trim Repairs
Elite Flooring & Interiors takes all reasonable precautions to minimize risk during the demolition process. However, by agreeing to our services, the client acknowledges and accepts that demolition work inherently carries a risk of unforeseen damage to existing structures, fixtures and furniture. EFI shall not be held liable for any direct, indirect, incidental or consequential damages resulting from or arising during the demolition phase, including but not limited to damage to walls, trim, cabinets, plumbing fixtures, furniture or adjacent materials.
Clients are encouraged to disclose any known structural vulnerabilities prior to the start of work. By proceeding with our services, you accept this disclaimer and release EFI from any claims related to demolition related damages. It is likely that the client will need to touch up paint after installation. If you plan to paint or wallpaper, this should be completed after installation. Newly applied paint and wallpaper is especially susceptible to damage.
Scheduled Installation Times
Estimated arrival and finish times are only a guide. Many circumstances during the day can cause our crews to run ahead or behind schedule. You will be notified if this happens.
Natural Products
A lot of our products are made from natural materials (stone tile, ceramic tile, wool, hardwood, etc.) and will have natural variations. Marble has natural veining. Ceramic tile is made from clay, which has natural variations in color and glazing. Wool is a natural product that has natural color variations. As a result, you should expect variations. These natural variations are not defects, and no refund or replacement will be made for natural products that have normal color, texture, and appearance variations.
Wood is also a natural product. No two pieces in hardwood are the same and will have variations due to knots and mineral streaking. Variations in appearance are completely normal. As your floor ages, some color change will occur, especially with exotic woods. This photosensitivity is normal but can be minimized by limiting exposure to direct sunlight and periodically moving furniture and rugs. Wood is a hygroscopic material. This means when wood is exposed to air, it will dry out or pick up moisture until it reaches equilibrium with the humidity and temperature of the air. Cracks are normal and will appear and disappear between floorboards during seasons of high and low humidity.
Pebble floors/Penny rounds
Elite Flooring & Interiors has found that over time, pebble floors and penny round tiles are more susceptible to problems with grout cracking, staining, holding water, and other issues. EFI will not warranty installing these types of tiles in wet spaces (ie: shower floors). If you choose to have these materials against our recommendation, it is at least recommended to have epoxy grout &/or seal your grout regularly but EFI will still not warranty any grout issues.
Wide Plank Hardwood
Although some manufacturers state that a nail-down installation is acceptable for wide plank flooring, EFI recommends either a “full-spread” or a “glue-assist” installation method on planks wider than 6 inches. EFI will not be held responsible for wide plank flooring that is not glued down.
Waste
Different flooring products require different percentages of waste to be calculated into the total amount of needed flooring. These percentages are simply a guideline. Sometimes, there will be additional material leftover after installation is complete. EFI will not issue any credits for leftover material.
Site Finished Hardwood
Floors should be inspected from a standing position with shoes on under medium, natural lighting. Inspecting floors lying down, using canned lights, flashlights, magnifying glass or with glare from windows is not an acceptable method. When floors are site finished by hand, they may contain a slight amount of particulate such as hair, sanding marks and finish marks. This occurs as part of being a man-made product in an open environment. We work very hard to minimize any imperfections. It is important for our clients to understand that allowances are made both by the NWFA (National Wood Flooring Association) and the manufacturers of the finishes and to have reasonable expectations for a finished floor. Industry standards allow for a very small amount of sanding marks, buffer swirl marks, and applicator marks. We take great care to smooth and level to the degree possible whatever imperfections may appear on the floor, but it’s important to us to maintain the structural integrity of the floor. Handcrafted work of any kind should and will show unique signs that it is handcrafted. Some permanent marks like deep water stains or urine may not come off when the floor is refinished. Upon request and with additional charges we can replace the damaged boards and further proceed with the refinishing process.
Maintenance
It is the sole responsibility of the customer to maintain their new flooring per recommendations from the manufacturer. All care and warranty for the brands of products we carry and install can be found online. EFI will not be responsible for improper use, inadequate maintenance, or failure to follow recommended maintenance and care guidelines.
